Several families in the Isthmus of Tehuantepec region had signed long-term (30-year) lease contracts with transnational wind energy companies under highly disadvantageous terms, with royalty payments far below market value and clauses severely limiting the use of their remaining lands.
We conducted a thorough legal audit of the original contracts, identifying defects in consent and one-sided clauses. We initiated an out-of-court renegotiation process with the warning of filing lawsuit for contract nullification due to lesion and economic disproportion.
We got the transnational company to the negotiation table, resulting in the signing of amendment agreements. The abusive restrictive clauses were eliminated and a 40% increase in economic considerations (royalties) was achieved in favor of the landowners, ensuring fair treatment for the use of their lands.
